Frequently Asked Questions

Intellectual Property

Provided below are some of the Frequently Asked Question relating to intellectual property.

  • When will I receive my trademark search report and opinion letter from Phase 1?

You will receive your search report and opinion letter within 7 days starting the day after you have completed the following steps: (1) returned a signed engagement letter, (2) submitted payment for services, and (3) completed our on-line intake form.

  • How much time do I have to make a decision to move forward with Phase 2 (Preparing and Filing Application) after receiving my trademark search report and opinion letter from Phase 1?

You have 7 days starting the day after you received both the trademark search report and opinion letter.

Because many trademark applications are filed daily with the United States Patent and Trademark Office, the risk of potential registration issues increase as the length of time increase between the completion date of your trademark search report and the filing date your trademark applications.

  • Do I have to do a trademark search?

No. You are not legally required to have a trademark search done prior to the filing of your trademark application. However, we highly encourage our client to have a trademark search done, because the trademark search serves as a tool to evaluate potential registration issues, such as a likelihood of confusion refusal.

  • What type of trademark search will I receive?

You will receive a preliminary trademark search that covers searching public records, such as the USPTO’s database (TESS), states’ database, internet search using Google search engine and domain search.
